Terms and Conditions Agreement

1. Kiddie Kabs, L.L.C. Inc. (from now on referred to at times as “Kiddie Kabs L.L.C.” ”Company,” “we,” or “us,” or “LLC”) welcomes you to our innovative trust-based ride service and the associated Applications, websites, content, and products (the “Services”). Below are the terms and conditions for using this Application and the Services (from now on referred to as “Terms and Conditions Agreement”).

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

1. By using or accessing the Services, you, as a result, agree to be bound by this Terms and Conditions Agreement. If you disagree with this Terms and Conditions Agreement, please do not access or use our Services. The terms and conditions contained herein supersede any prior arrangement or agreements between us, are subject to change, and can be modified or supplemented at any time with notice to you. Posting such modified or supplemental terms here shall constitute notice to you. Your continued use of the Services following such notification shall constitute your acceptance. Certain areas within or portions of the Kiddie Kabs, L.L.C. Materials may be governed by additional terms and conditions (“Additional Terms”) presented in conjunction with the same. The Additional Terms and this Terms and Conditions Agreement apply to you. In the event of an irreconcilable inconsistency between the Additional Terms and this Terms and Conditions Agreement, this Terms and Conditions Agreement control. Be sure to review this Terms and Conditions Agreement periodically for updates, as your continued use of the Services signifies your acceptance of any changed or supplemental terms and conditions.

2. We may immediately terminate the Terms and Conditions Agreement or any Services concerning you, or generally, cease offering or prevent further access to the Services or any portion thereof, at any time for any reason, without prior notice to you.

Note that the headings contained in this Terms and Condition Agreement are inserted for convenience of reference only and shall not in any way define or affect the meaning, construction, or scope of any of the provisions in this Terms and Conditions Agreement. This English-language Terms and Conditions Agreement is Kiddie Kabs, L.L.C.’s official agreement with our users. In case of any inconsistency between this English-language Terms and Conditions Agreement and its translation into another language, this English-language document shall control.

2. Kiddie Kabs, L.L.C.’s Services

Kiddie Kabs, L.L.C. provides transportation services to users and is a transportation carrier. Our Services comprise a seamless, technology-based platform that includes mobile applications, websites, and other points of entry (each an “Application”) through which users can connect with and schedule transportation and related services with Kiddie Kabs, L.L.C.

We may offer our services under one or more brands, alone, or in connection with others, from time to time, including Kiddie Kabs, L.L.C.

Our Applications, the Kiddie Kabs, L.L.C. marks, and all our content (including, without limitation, text, photographs, images, illustrations, graphics, video material, audio material, services, products, and software) shall be referred to collectively herein as the “Kiddie Kabs, L.L.C. materials.”

3. Eligibility

The Kiddie Kabs, L.L.C. Platform is available only to and may only be used by individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, the Kiddie Kabs, L.L.C. Platform is not available to children (persons under the age of 18) or Users who have had their User account temporarily or permanently deactivated. By becoming a User, you represent and warrant that you are at least 18 years old and have the right, authority, and capacity to enter into and abide by the terms and conditions of this Agreement.

4. Third-Party Services and Materials

Third-party services and/or content, including advertising (“Third Party Materials”), may be made available or accessed in connection with the Services or Kiddie Kabs, L.L.C. Materials. Kiddie Kabs, L.L.C. does not control, endorse, or otherwise promote such third parties and/or the Third-Party Materials. Different terms of use and privacy policies may apply to such material, and you are solely responsible for the same. You acknowledge and agree that Kiddie Kabs, L.L.C. shall have no responsibility or liability to you associated with such Third-Party Materials. Some third parties, such as Apple Inc., Square Inc., Google, Inc., Microsoft Corporation, and others, may be considered third-party beneficiaries to this Terms and Conditions Agreement if you access the Services using devices or applications they developed (e.g., Apple IOS). Your access to the Services using such devices is also subject to any applicable terms and conditions such third parties impose.

5. Limited License

Subject always to your compliance with this Terms and Conditions Agreement, Kiddie Kabs, L.L.C. grants you a limited license, under which you may access and use the Services, and any Kiddie Kabs, L.L.C. materials offered or provided in connection with your use of the Services solely for your personal, non-commercial use. Your license is revocable, non-exclusive, and may not be transferred or sublicensed to others. As between Kiddie Kabs, L.L.C., and you, any rights not expressly granted to you in the paragraph immediately above are reserved by Kiddie Kabs, L.L.C., and its licensors and/or subsidiaries.

6. Ownership and Intellectual Property

The Services, the Kiddie Kabs, L.L.C. marks, and other portions of the Kiddie Kabs, L.L.C. materials are protected by the intellectual property of Kiddie Kabs, L.L.C., and its licensors and/or subsidiaries. The Services and the Kiddie Kabs, L.L.C. materials are protected, as applicable, by copyright, patent, trademark, and other laws of the United States, as well as international conventions and the laws of other countries. The Services and Kiddie Kabs, L.L.C. materials are owned or controlled by Kiddie Kabs, L.L.C. or its licensors, subsidiaries, and/or the party credited as the provider. Additionally, portions of the Kiddie Kabs, L.L.C. materials, e.g., the Applications, are protected by copyright as a collective work and/or compilation. Except as expressly outlined above, your use of the Services and/or Kiddie Kabs, L.L.C. materials does not create. Nothing contained in this Terms and Conditions Agreement shall be construed as creating or conferring to you, by implication, estoppel, or otherwise, a license or any other rights in or to the Services, the Kiddie Kabs, L.L.C. materials, or any patents, trademarks, service marks, logos, copyrights or other intellectual property or proprietary rights or any other rights of Kiddie Kabs, L.L.C. or any third party.

With respect to the Services and the Kiddie Kabs, L.L.C. materials, you agree to the following restrictions:

No portion of the Services or Kiddie Kabs, L.L.C. materials may be reproduced, duplicated, copied, sold, licensed, leased, transferred, transmitted, streamed, broadcasted, repackaged, or otherwise exploited for any commercial purpose that Kiddie Kabs, L.L.C. do not expressly permit before any such activity.
You may not attempt to alter or modify the Services or any Kiddie Kabs, L.L.C. materials or any content posted on or otherwise available through same.
You may not remove any copyright, trademark, or other proprietary or statutory notices from any portion of the Services or the Kiddie Kabs, L.L.C. materials.
You may not copy, download, display, distribute, publish, enter into a database, perform, modify, create derivative works, transmit, post, decompile, reverse engineer, disassemble, or in any way use any of the Kiddie Kabs, L.L.C. materials or any related intellectual property or other proprietary rights.
You may not link to, mirror, or frame any portion of the Services or Kiddie Kabs, L.L.C. materials.
You may not scrap, index, survey, or otherwise attempt to obtain data from, other gains unauthorized access to, hinder, or unduly burden in any way or manner any portion of the Services or the Kiddie Kabs, L.L.C. materials.

7. Use of the Services

Registration and Kiddie Kabs, L.L.C. accounts

Services users must register for and maintain an active account with us (each a “Kiddie Kabs, L.L.C. account”).

You can have up to one active Kiddie Kabs, L.L.C. account anytime. You acknowledge and agree that you are solely responsible for all activity that occurs on or through your Kiddie Kabs, L.L.C. account and that you are solely responsible for the selection, security, and protection of your username and password for your Kiddie Kabs, L.L.C. account. Kiddie Kabs, L.L.C. Account holders may arrange to use the Services for people for at least 5 years without accompanying a parent, guardian, or another responsible adult. This means persons under five years old may only use the Services if accompanied by a parent, guardian, or another responsible adult.

Without limiting the foregoing, you may not assign or otherwise transfer your Kiddie Kabs, L.L.C. account to any other person or entity. You may not access or use the Services for any unlawful purpose and agree to comply with all applicable laws and regulations when accessing and using the Services.

You acknowledge and agree that your failure to adhere to any of the terms and conditions applying to the Kiddie Kabs, L.L.C. account may result in the termination of your Kiddie Kabs, L.L.C. account and your inability to further access or use the Services.

You are solely responsible for obtaining and maintaining the means for accessing and using the Services. If you access and use our Services via a mobile network, your network provider's data, messaging rates, and fees may apply. Kiddie Kabs, L.L.C. does not guarantee that the Services, the Kiddie Kabs, L.L.C. materials, or any portion thereof will function on any hardware or devices or that same will be available through any network or service. You acknowledge and agree that the Services may be subject to interruption, errors, malfunctions, and delays caused by using the Internet, your access device(s), and network(s), and otherwise inherent to electronic communications.

By accessing and using the Services via your Kiddie Kabs, L.L.C. account, you agree that we may contact you in connection with your access and use of same, including, without limitation, sending you informational text (SMS) messages and/or e-mail. You may opt out of receiving text (SMS) messages at any time by sending us an e-mail at Services@kiddiekabs.com. You understand that you are opting out of receiving text (SMS) messages from us may negatively impact your access to and use of the Services.

To register for a Kiddie Kabs, L.L.C. complete account, you must be at least eighteen (or the age of legal consent, if different from 18 years in your jurisdiction).

You will need to provide the following information in registering for a Kiddie Kabs, L.L.C. complete account:

Your name and address
Your contact information (e.g., cellphone number; e-mail address)
At least one payment method (e.g., credit card or other accepted payment source).

You further agree to maintain all the above information (“Kiddie Kabs, L.L.C. account Information”) so that it is accurate, complete, and up to date at all times. You may be asked for proof or other verification of the Kiddie Kabs, L.L.C. account Information in connection with your access to and use of the Services. Inaccurate or incomplete Service Account Information may result in losing access to and use of the Services. You may register for a Kiddie Kabs, L.L.C. account at kiddiekabs.com.

Additional Restrictions and Responsibilities

Neither you nor any user accessing or using the Services through your Kiddie Kabs, L.L.C. account will cause any nuisance, inconvenience, or property damage, whether to an Independent Service Provider or any other person or entity.

You shall be solely responsible for the costs associated with the repair of or replacement based upon damages to, including necessary cleaning of, the property of Kiddie Kabs, L.L.C., including any vehicles and other property, that results from the use of the Services under your Kiddie Kabs, L.L.C. account, provided that such damages or cleaning are more than normal "wear and tear" damages and necessary cleaning associated with same. In Kiddie Kabs, L.L.C.’s sole discretion, we may use the Payment Method associated with your Kiddie Kabs, L.L.C. account to cover the reasonable costs of any such excessive damage, repair, or replacement. Such amounts will be provided to Kiddie Kabs, L.L.C., and are non-refundable to you.

8. Fees and Payment

You acknowledge and agree that your use of the Services will result in charges to you for the use of the Services or goods or other services you obtain through the Services. Fees will include all applicable taxes and additional costs (e.g., tolls, surcharges, administration, registration, deposit, taxes, etc.).

You are solely responsible for any and all fees charged to your Payment Method by the issuer, bank or financial institution, or payment partner, including, but not limited to, membership, overdraft, insufficient funds, and over-the-credit limit fees.

The payment of Fees by you shall be final and non-refundable unless otherwise agreed to between Kiddie Kabs, L.L.C., and you.

At its sole discretion, Kiddie Kabs, LLC may make promotions with different features available to any of our Riders or prospective Riders. Unless made to you, these promotions shall not affect your Agreement or relationship with Kiddie Kabs, L.L.C.

All charges are facilitated electronically through a third-party payment processing service (e.g., Stripe, Square, Inc., or Braintree, a division of PayPal, Inc.). Kiddie Kabs, L.L.C. may replace its third-party payment processing services without notice to you. Charges shall only be made electronically through the Kiddie Kabs, L.L.C. platform. Cash payments are strictly prohibited.

Payments are NOT prorated. Whether you use the Service 1 day per week, five days per week, 20 days per month, or ten days per month, you must pay for full weeks or months of service. Payment of fees is expected regardless of personal vacation or holiday, school vacation, holiday, or short-term illness. For example, if the school is open from Monday to Wednesday but closed on Thursday and Friday, you will still be accountable for the entire week of service. This policy also applies to holidays such as Christmas Break, Spring Break, etc. If you disagree with this policy, please do not register for this Service, as you will be charged accordingly.

All Fees are due before receipt of the associated services or goods. Kiddie Kabs, L.L.C., shall facilitate payment electronically to Kiddie Kabs, L.L.C. using the Payment Method on file associated with your Kiddie Kabs, L.L.C. account and will provide you with a receipt afterward.

If your Payment Method on file at any point becomes invalid (e.g., it reaches its original expiration date), you continue to incur fees via the use of the Services. In that case, you agree that we are authorized to continue billing by that Payment Method. Suppose your Payment Method will not accept charges for any fees owed to us. In that case, you will incur a $50 late fee and have a period of one (1) day from the date that your Payment Method was declined to make your Payment Method information valid again by rectifying the issue with the Payment Method source or providing new Payment Method information to us. If Kiddie Kabs, L.L.C. can charge your Payment Method (existing or new if you have provided new Payment Method information)

During the one (1) day period, by 3:00 PM, Eastern Standard Time, your use of the Services will continue uninterrupted. However, if Kiddie Kabs, L.L.C. cannot charge your Payment Method (existing or new if you have provided new Payment Method information) within one (1) day, then you will incur a $50 late fee AND your use of the Services will be suspended the following day and will continue to be suspended until all fees due have been paid. Three (3) occurrences of interrupted payment during a school year or during summer break may result in indefinite suspension.

Regarding our Fees and payments, you acknowledge and agree that.”

Kiddie Kabs, L.L.C. has the right, in its sole discretion, to establish, remove and/or modify Fees for any or all services or goods obtained using the Services at any time.
Fees may fluctuate in certain geographies during certain conditions (e.g., high demand).
Although we will make reasonable efforts to inform you of applicable fees that apply to your use of the Services, you remain responsible for any such Fees regardless of such notice.
Kiddie Kabs, L.L.C. has the right to levy a cancellation fee per the ride cancellation policy described below.
Kiddie Kabs, L.L.C. has the right to levy a standing time fee per the standing time policy described in detail below.
The Fees are calculated only to compensate Kiddie Kabs, L.L.C. for the services or goods you receive through the Services.
The Fees do NOT include any tip or gratuity you may decide to provide to the Kiddie Kabs, L.L.C. driver. It is entirely up to you whether to give any such tip or gratuity.
Other fees, tolls, and surcharges may apply to your ride, including actual or anticipated airport fees, state or local fees, tolls (and return tolls in select instances), and

Processing/administration fees for split payments. In addition, where required by law, Kiddie Kabs, L.L.C. will collect applicable taxes.

Kabs, L.L.C. driver or any employee of Kiddie Kabs, L.L.C. in any way that attempts to or does circumvent the Services and the fees and payment terms set forth herein, including, without limitation, by paying cash or other consideration directly to the Kiddie Kabs, L.L.C. driver, or any other employee of Kiddie Kabs, L.L.C. or otherwise act outside of such terms. Kiddie Kabs, L.L.C. reserves the right to suspend and/or terminate your account (as well as sever its relationship with any associated driver(s) if you violate these terms at will without prior notice.

It is necessary for you to provide a valid payment method to Kiddie Kabs, L.L.C. for the use of payment of services. All billing is done electronically monthly or bi-weekly with a major debit or credit card and is due before service is rendered.

8. Standing Time Policy

Standing time is a feature that allows drivers to be compensated for time spent outside of a ride while waiting for a rider to get to the vehicle or enter their destination. A $2 per minute (not to exceed 5 minutes) fee is accrued for the time a driver spends after they arrive at the drop-off location and/or if the driver spends more than 15 minutes at pickup. Standing time appears as a separate line item on your receipt.

9. Ride Cancellation Policy

To cancel your transportation services, kindly send an email with two weeks’ notice. NO refunds for cancellations made before the agreed date or at the end of the school year will be issued. Upon making a payment, you are obligated to utilize the transportation service for the Agreed term. If you cancel the service without two weeks’ notice before the agreed end date or the school year’s end, a fee of $250 will be charged to your account.

10. User-Provided Materials

In connection with your access to and use of the Services or Kiddie Kabs, L.L.C. materials, you may be allowed from time to time to submit, upload, publish, or otherwise provide to us certain information, content, or other materials, such as text, audio, and/or visual content and data (“User-Provided Materials”). Examples of such User-Provided Materials include ratings, commentary, suggestions, testimonies, ideas, and other feedback related to the Services and/or Kiddie Kabs, L.L.C. materials, technical or other support requests, and entries for competitions and other promotions. You agree not to provide any User-Provided Materials that are defamatory, libelous, hateful, violent, obscene, pornographic, unlawful, or, in our sole judgment, offensive, whether such materials may be protected by law. Kiddie Kabs, L.L.C. reserves the right but does not undertake any responsibility to review, monitor, and/or remove User-Provided Materials, at our sole discretion and for any reason, including our convenience, without notice to you.

As between you and Kiddie Kabs, L.L.C., any User-Provided Materials remain your property, subject only to the following license to us: You hereby grant to Kiddie Kabs, L.L.C., and Kiddie Kabs, L.L.C. hereby accepts a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up license, with full rights to sublicense, to receive, make, use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit In any manner, such User-Provided Materials in all formats and via all distribution methods, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.

You hereby represent and warrant the following concerning any User-Provided Materials:

You are the sole and exclusive owner of all such User-Provided Materials, or you have all rights, consents, and releases necessary to provide the same to us and grant Kiddie Kabs, L.L.C. the license set forth above.
Neither the User-Provided Materials nor our use of same and permitted under the license set forth above will infringe, misappropriate, or otherwise violate any third party's intellectual property or other proprietary rights, or rights of publicity or privacy, or will otherwise result in the violation of any applicable law or regulation.

11. Opt-In Safety Features.

One of the unique features of Kiddie Kabs, L.L.C., is its enhanced safety features. One such feature allows you to have a photographic/video record made using the Services, Account holders tied to your Kiddie Kabs, L.L.C. account. The Kiddie Kabs, L.L.C. employee (s) will capture photographic/video and potentially audio of the use of the Services. This session will be recorded and broadcast (e.g., to you as a parent of a Kiddie Kabs, L.L.C. account user) without any opt-in. If you opt-in to Kiddie Kabs, L.L.C. customer support video monitoring, the session will be recorded, broadcasted, and provided to Kiddie Kabs, L.L.C. specialists (to assist in monitoring the use of the Services). It will be stored indefinitely by Kiddie Kabs, L.L.C. for any lawful purposes, including providing the same to law enforcement. Without limiting the preceding, you hereby agree that by opting into this feature: (a) you now grant permission to the rights of your image, likeness, and sound of your voice as recorded on any audio or video media without payment or any other consideration; (b) as between you and Kiddie Kabs, L.L.C.,

Kiddie Kabs, L.L.C. shall own such recorded materials; (c) Kiddie Kabs, L.L.C., and the related Independent Service Provider(s) have the full rights to capture, use and store such video and audio, including your image, voice, and those of other users tied to your Kiddie Kabs, L.L.C. account (whether accompanied by you or not), as outlined herein; (d) your image/likeness/voice may be edited, copied, exhibited, published or distributed; and (e) you waive the right to inspect or approve the finished product wherein your likeness or other materials appear.

12. Legal Disclaimers; Limitation of Liability; and Indemnity Disclaimers.

You acknowledge and agree to the following disclaimers to the maximum amount allowed by applicable law:

The services are provided “as is” and “as available” with no other representations, warranties, or guarantees by Kiddie Kabs, L.L.C., its affiliates, or any other party.
Kiddie Kabs, L.L.C. hereby disclaims any and all representations and warranties, express, implied, or statutory, not expressly set out in these terms and conditions agreement, including:
- THE IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE; AND
- NON-INFRINGEMENT.
Kiddie Kabs, L.L.C. also makes no representation, warranty, or other guarantees regarding the service’s reliability, availability, timeliness, quality, suitability, or any services or goods requested using the service.
Kiddie Kabs, L.L.C. also makes no representation, warranty, or promises that the services will be secure, free of viruses or other harmful components, uninterrupted, or error-free.

13. Limitations of Liability

You acknowledge and agree to the following limitations of liability to the maximum amount allowed by applicable law:

Under no circumstances shall Kiddie Kabs, L.L.C, its affiliates, or their respective officers, directors, employees, or agents be liable for:
- Any indirect, incidental, special, exemplary, punitive, or other consequential damages, including lost profits, lost data, personal injury, or property damage related to, arising from, in connection with, or otherwise resulting from any use of the services and/or any services and goods obtained through the services, even if Kiddie Kabs, L.L.C. is aware or has been advised of the possibility of such damages.
- Any damages, liability, or losses arising out of:
  - Your access to, use of, or reliance on the services or your lack of such access or use; or
  - Any interaction, transaction, or relationship between you and any employee, even if Kiddie Kabs, L.L.C. is aware or has been advised of the possibility of such damages.
- Delay or failure in the services resulting from any causes beyond Kiddie Kabs, L.L.C.’s reasonable control.
- Any physical or emotional injury, bodily harm, or death to any users, including Kiddie Kabs, L.L.C. junior account holders, as a result of or in connection with the services.
In no event shall Kiddie Kabs, L.L.C.’s total liability to you in connection with the services for all damages, losses, injuries, harms, and causes of action exceed two hundred and fifty U.S. dollars (US $250). .

14. Indemity

You hereby agree to indemnify and hold Kiddie Kabs, L.L.C., its Affiliates, and their respective officers, directors, employees, and agents harmless from any and all actual or threatened claims, demands, losses, liabilities, and expenses (including reasonable attorneys' fees and costs of suit), arising from, or in connection with (a) your use of the Services, the Kiddie Kabs, L.L.C. materials or services or goods obtained through the Services; (ii) your breach or other violation of any of the terms and conditions outlined in this Terms and Conditions Agreement; (iii) Kiddie Kabs, L.L.C.’s receipt, and use of User-Provided Content as authorized herein; (iv) any transaction or activities between you and any Independent Service Provider or any other third party, including any users with Kiddie Kabs, L.L.C., Accounts tied to your Kiddie Kabs, L.L.C. account; or (v) your violation of any applicable law or regulation.

15. No Waiver

No delay or failure by Kiddie Kabs, L.L.C. to enforce any of the terms and conditions outlined in this Terms and Conditions Agreement shall constitute a waiver of any of our rights under this Terms and Conditions Agreement. Neither the receipt of any funds by Kiddie Kabs, L.L.C. nor the reliance of any person on our actions shall be deemed to constitute a waiver of any part of this Terms and Conditions Agreement. Only a specific, written waiver signed by an authorized representative of Kiddie Kabs, L.L.C. shall have any legal effect.

16. Sever-ability

Suppose any clause or provision outlined in this Terms and Conditions Agreement is determined to be illegal, invalid, or unenforceable under present or future law. In that case, the clause or provision shall be deemed to be deleted without affecting the enforceability of all remaining clauses or provisions.

17. Governing Law and Jurisdiction

This Terms and Conditions Agreement and any disputes arising under or related to this Terms and Conditions Agreement, the Services, the Kiddie Kabs, L.L.C. materials, our Privacy Policy, and/or any Additional Terms shall be governed by the laws of the State of Massachusetts without reference to its conflict of law principles. You agree to submit to the exclusive personal jurisdiction and venue of the courts located within Massachusetts for any legal proceeding arising from the same, regardless of the cause of action or which party has initiated the legal proceeding.

18. Claims of Copyright Infringement

Kiddie Kabs, L.L.C. values its intellectual property and respects the intellectual property rights of others. Please report claims of copyright infringement here.

19. Kiddie Kabs, L.L.C. Rules

To effectively use the Services by various users, we have established the Kiddie Kabs, L.L.C. Rules below.

There are several ways to utilize the Services to participate in a ride:

As a Kiddie Kabs, L.L.C. Full Account holder (“Account Holder”).
As a passenger accompanying the Account Holder on a ride (“Other Passenger”).
As a coach, teacher, or chaperone receiving pickup instructions (“Supervisor”)

By participating in rides via the Services as a Passenger or Driver, you agree to abide by these Kiddie Kabs, L.L.C. Policies.

20. The Ride

Only Passengers listed on the initial reservation may join a ride. Until Kiddie Kabs, L.L.C. launches a carpool feature; parents may add additional Passengers in the notes section of the ride.
A mobile device in the rider’s possession is highly recommended. Still, it does not require that (a) is capable of voice and SMS communication and (b) has been registered with Kiddie Kabs, L.L.C. (e.g., as part of the Passenger’s contact information).
Passengers under ten are not allowed to ride in the front seat.
While riding in a Kiddie Kabs vehicle, passengers must refrain from engaging in horseplay and keep their hands, feet, and body parts to themselves. Failure to comply with these rules may lead to suspension or termination of service. In case of a rule violation, Parents/Guardians will be informed. The initial notification will serve as an explanation, but if the behavior continues, the passenger will be suspended for 1-5 days depending on the violation. If suspension of service does not result in a behavior change, termination of service will occur.
Passengers must use seat belts during a ride and follow all applicable laws.
Pets are not allowed on a ride.
Passengers and Drivers are solely responsible for their personal belongings. Kiddie Kabs, L.L.C. shall not be liable for lost or stolen items.
Passengers should use the Kiddie Kabs, L.L.C. vehicle with proper care and respect. Any damage to vehicles by Passengers may result in a charge of up to US$300.00. Drivers are encouraged to take photos of any such damage(s) to assist in documenting the same.

Examples of One-Way Trips:

We will pick up the student(s) from your home.
We transport the student(s) to school.

We pick up the student(s) from school.
We transport the student(s) to extracurricular activity/practice.

We pick up the student from extracurricular activity/practice.
We transport the student(s) to their homes.

Example of Round Trip:

We pick up the student from your home and transport the student to school.
We pick up the student from school and transport the student home.

We pick up the student from your home and transport the student to extracurricular activity/practice.
We pick up the student from extracurricular activity/practice and transport the student home.

21. After the Ride

The Services allow for formal feedback from all ride participants about a Driver, including a Driver’s promptness, attitude, safety, and vehicle quality. Excessive and/or consistent negative feedback about a Driver will be investigated and could result in that Driver's temporary or permanent suspension.

The Services also allow Drivers to provide formal feedback about Passenger(s), including a Passenger’s promptness, attitude, and other actions. Accumulation of an excessive and/or consistent level of negative feedback by a Passenger may be investigated and could result in the temporary or permanent suspension of that Passenger.

Driver Misconduct/Suspension/Zero Tolerance Policy/Vehicles

Kiddie Kabs, L.L.C. reserves the right but does not undertake the obligation, to suspend any Driver upon a report of any Driver misconduct associated with a ride, including, without limitation, any unsafe driving, violation of the Kiddie Kabs, L.L.C. rules, or inappropriate behavior. During the suspension, the Driver will not be allowed to provide any rides via the Services. Kiddie Kabs, L.L.C. may investigate the reported misconduct, during which Kiddie Kabs, L.L.C. will contact the Driver and any relevant Passengers and/or Account Holders for an account of such circumstance. Based on the investigation results, Kiddie Kabs, L.L.C. will decide in its sole discretion whether to lift the stay or permanently suspend the Driver from the Services. All decisions are final.

Kiddie Kabs, L.L.C. maintains a zero-tolerance policy regarding Drivers who, during a ride:

use alcohol, illegal substances, or misuse prescription medications; or
violate applicable traffic laws and/or driving recklessly: or
take a child somewhere other than where they have been directed to take them.

Upon any such violations, Kiddie Kabs, L.L.C. reserves the right to terminate or suspend the Driver’s use of the Services pending further investigation.

For the provision of rides via the Services, Drivers are only allowed to use vehicles that are properly registered and inspected for same.
